ARTICLE 2 – PURPOSE AND SCOPE

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Le Labyrinthe En-Champ-Thé with consumer or non-professional buyers wishing to acquire:

  • Physical products (teas, essential oils, hydrosols, preserves, syrups, shortbreads, etc.) shipped to La Réunion and Mainland France;
  • Service performances and leisure activities (tours, workshops) booked online.

The customer is required to read these General Terms and Conditions of Sale before placing any order. Validating an order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

ARTICLE 3 – PRODUCTS AND AVAILABILITY

The products governed by these General Terms and Conditions of Sale are those displayed on the website. They are offered subject to stock availability. Photographs and visual illustrations of products are non-contractual and shall not engage the seller's liability.

ARTICLE 4 – PRICES AND TAXATION (LA RÉUNION AND MAINLAND FRANCE)

Product prices are indicated on the website in Euros (€).

  • Deliveries within La Réunion (DROM): Prices are displayed inclusive of all taxes (TTC), including VAT applicable in La Réunion (standard rate of 8.5% or reduced rate of 2.1% depending on the product type).
  • Deliveries to Mainland France: In application ofArticle 294 of the French General Tax Code (CGI),La Réunion being outside the EU VAT territory, sales of goods shipped from La Réunion to Mainland France are exempt from VAT.Invoices and order confirmations bear the corresponding statutory VAT exemption notice.

Prices do not include processing, shipping, and delivery fees, which are charged additionally and calculated prior to final order confirmation.

ARTICLE 5 – ORDERING PROCESS AND PAYMENT

The customer selects the products they wish to order, adds them to their cart, and validates their cart after checking its contents. The customer provides delivery and billing details, selects a delivery method, and proceeds to secure payment.

Payment Terms: Payment for purchases is made by Credit Card via the secure payment solution Up2pay (Crédit Agricole)The order becomes final and binding upon confirmation of payment by the banking institution.

ARTICLE 6 – DELIVERY AND CUSTOMS FORMALITIES

6.1 Delivery Zones: La Réunion (DROM) and Mainland France.

6.2 Handling and Dispatch Times: Orders are prepared and handed over to the carrier within 48 to 72 business hours following confirmation and payment of the order (excluding weekends and public holidays).

6.3 Transport Method and Indicative Delivery Times: Deliveries are handled by Colissimo (La Poste). From the moment the package is collected by the carrier, typical delivery times are as follows:

  • La Réunion: 2 to 4 business days;
  • Mainland France: 5 to 10 business days.

The seller cannot be held responsible for delivery delays attributable exclusively to the carrier (La Poste/Colissimo) or arising from events beyond its control (exceptional bad weather, severe local/cyclonic weather conditions, transport service strikes, air freight disruptions).

6.4 Customs Formalities and Ancillary Fees (Mainland France): For shipments to Mainland France, the seller completes all export customs formalities (EORI number and assigned HS codes). The customer is informed that packages may be subject to customs inspections upon arrival, and that any potential customs clearance fees, local taxes, or import duties applied upon arrival remain the exclusive responsibility of the recipient.

ARTICLE 7 – RIGHT OF WITHDRAWAL

7.1 General Principle (Physical Products)

In accordance with Article L. 221-18 of the French Consumer Code, the customer has a period of fourteen (14) clear days from receipt of their products to exercise their right of withdrawal with the seller, without having to justify reasons or pay penalties.

7.2 Legal Exceptions and Unsealed Products

In accordance with Article L. 221-28 5° of the French Consumer Code, the right of withdrawal cannot be exercised for goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.

Consequently:

  • Bags/boxes of shortbreads or food items sealed with a tamper-evident label or opening seal cannot be returned under the right of withdrawal if the label or seal has been broken or damaged.
  • Bottles of essential oils or hydrosols equipped with a tamper-evident ring will neither be taken back nor refunded if opened or unsealed.

7.3 Exercise Methods and Return Costs

To exercise the right of withdrawal, the customer must notify their decision by means of an unambiguous statement (by email to info@enchampthe.com or by post) or using the standard form attached in the Appendix to these General Terms and Conditions of Sale.

Return Costs: In accordance with Article L. 221-23 of the French Consumer Code, direct costs of returning the products remain at the exclusive expense of the customer.

Products must be returned in their original condition and complete (packaging, accessories, instructions) to the seller's registered office. Refunds will be processed using the same payment method used for the initial transaction within 14 days of receiving the returned products.

7.4 Exclusion for Activity and Tour Bookings

In accordance with Article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to the provision of leisure activity services that must be provided on a specific date or period. Online bookings for tours or workshops do not benefit from a legal right of withdrawal.

ARTICLE 8 – LEGAL WARRANTIES

The seller is bound by statutory guarantees of product conformity under Article L. 217-4 et seq. of the French Consumer Code and against hidden defects under Article 1641 et seq. of the French Civil Code.

ARTICLE 9 – LIABILITY AND FORCE MAJEURE

The seller cannot be held liable for non-performance of the contract in the event of stock shortages, occurrence of force majeure events (notably severe weather events, cyclones, postal or transport strikes), or customer fault.

ARTICLE 10 – COMPLAINTS AND CONSUMER MEDIATION

In the event of a dispute, the customer should first contact customer service by email (info@enchampthe.com) or phone (06 92 60 18 88).

In accordance with Articles L. 616-1 and R. 616-1 of the French Consumer Code, if a complaint to customer service fails or receives no response within two months, the consumer may submit the dispute free of charge to the following consumer mediator:

European Online Dispute Resolution (ODR) Platform: The European Commission also provides an online dispute resolution platform, accessible at: https://ec.europa.eu/consumers/odr/.

ARTICLE 11 – APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute that cannot be settled amicably, French courts shall have exclusive jurisdiction.

ARTICLE 12 – PERSONAL DATA AND COOKIES
